What is a Personal Injury?

In legal-speak, a personal injury occurs when someone receives injuries due to the negligence of another party. The other party could be a business, a manufacturer, a city, a county, a driver, a family’s pet, a doctor, an organization, or any other entity that caused an accident which injured you.

The types of cases most generally associated with personal injury include:

  • Vehicle accidents
  • Slips and falls
  • Dog-bite injuries
  • Boating accidents
  • Workers’ compensation
  • Defective products
  • Medical malpractice
  • Pedestrian accidents
  • Bicycle accidents
  • Motorcycle accidents, and more

Example of a Personal Injury Accident

Just for explanation purposes, let us say you are walking down Winthrop Ave., near City Hall and a bicyclist runs into you, and you fall to the ground. Luckily Massachusetts General Hospital Healthcare Center is nearby at 300 Ocean Ave., so you call 911 to get help for what seems to be significant injuries.

Once you reach the clinic, the doctors say you have a fracture in your tibia bone, and you will need stitches in both your hands.

(According to Science Daily, bicycle accidents have skyrocketed because of the popularity of using bicycles. Medical costs have climbed by $789 million a year.)

You will be in the hospital a few days, so who will pay for your medical bills? Who was at fault for your injuries? What is your next step?

These issues are what personal injury is all about, and this is why your Revere, MA, Personal Injury Lawyer wants to set up a free consultation appointment to discuss your case. If you cannot come to them, they will come to you.

What Factors are Used to Choose a Personal Injury Attorney?

Word of mouth is one of the best ways to find attorneys who are trusted, experienced, and who have a positive track record. Another way to get an idea of the caliber of the law team you want to represent you is to look at the cases they have handled and how much they have positively impacted their clients.

When we took on the case of a pedestrian who was involved in a vehicle crash, our client suffered broken bone injuries. Our team accessed three insurance policies to increase our client’s recovery. A settlement was arrived upon in the amount of $145,000.

While driving her family in her vehicle, a vehicle coming in the opposite direction crossed the center line and struck her automobile head-on. The fracture to her wrist, a result of the accident, lessened her ability to accomplish her work as a writer. Our $100,000 settlement amount allowed her to have surgery to repair her wrist, we also argued in favor of an award of the policy limits for both her medical bills and her pain and suffering.

A client was crossing the street when struck by a vehicle and suffered broken bone injuries. Our negotiations released the driver’s $100,000 insurance policy. After a lawsuit, we secured the drive’s entire insurance policy plus an added $17,000 which was paid by the driver directly.

What are Damages?

As a result of your accident, you may find that issues have arisen from injuries, hospital stays, or other issues due to no fault of your own. Problems that consistently occur because of a personal injury case can include:

  • Medical costs
  • Loss of wages
  • Loss of future wages
  • Rehabilitation costs
  • Pain and suffering
  • Emotional distress
  • Loss of consortium (legal-speak for loss of companionship or relationship with family or spouse)
  • Wrongful death

There are two elemental types of damages. Economic damages are compensations for verifiable monetary losses, such as hospital bills, loss of earning ability, the cost of a damaged vehicle or other property, and so on. Non-economic damages are compensation for the inconvenience of being injured, the emotional distress that comes with being injured, losing the enjoyment of life, and other similar issues.

Punitive damages are for punishment of the party at fault. The penalty is meant to deter reckless behavior and intentional malice.

What Might Cause Decreased Compensation?

As already stated, the party who was negligent and caused the accident to happen is responsible for paying whatever compensation is due to the victim. In Massachusetts, personal injury laws include the following parameters:

  • A three-year deadline (in legal-speak “statute of limitations”) for filing a lawsuit
  • A change in the three-year deadline starting date if the victim suffered an injury that was not detectable until after the accident.
  • A two-year deadline for filing a formal claim for injuries against a city, county, or state governmental agency
  • A three-year deadline to file a lawsuit
  • Reduced damages if the victim shares less than 50 percent the fault (comparative fault rule)
  • Eliminated damages if the victim shares 50 percent or more of the blame
  • Massachusetts is a no-fault state (in this state, vehicle owners are required to have bodily injury to others coverage of $20,000 a person, 440,000 per accident; personal injury protection [PIP] of $8,000 per person, per accident; bodily injury coverage caused by an uninsured auto owner of $20,000 per person and $40,000 per accident; and damage to another person’s property, $5,000 per accident)
  • Working with insurance companies after an accident can be difficult and go on for an extended time
